Waiver of Liability

In consideration for receiving permission to participate in the CROSSFIRE HANGOUT (hereinafter the “Event”) being conducted on FRIDAY, JANUARY 31st I (We), PARENT/GAURDIAN SIGNED BELOW , being the legal parent(s)/guardian(s) (hereinafter “Parent”) of PARTICIPANT NAMED BELOW (hereinafter “Child”), do hereby grant permission for Child to participate in all activities conducted as part of the Event (hereinafter “the Activities”). Parent hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Family Worship Center Church, Jimmy Swaggart Ministries, Crossfire Youth Ministries, the Board of Trustees, its owners, directors, officers, agents, employees, members, volunteers, representatives, assigns or others acting on their behalf (hereinafter collectively referred to as “FWCC”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Child, or to any property belonging to Child, while participating in the Event, while in, on or upon the premises where the activities of the Event are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE FWCC, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

 

2. Parent hereby waives any and all rights Parent, Parent’s heirs, representatives or assigns may have against FWCC to assert any cause of action, possible cause of action, claim or demand of any nature whatsoever, including but not limited to a claim for negligence or gross negligence which Parent, Parent’s heirs, representatives or assigns may have now, or in the future, for personal injury or damage arising from Child’s participation in the Event and/or Activities, including but not limited to, the negligence, gross negligence, reckless or wanton conduct of FWCC or the conduct of any party connected in any way with FWCC.

 

3. Parent further agrees to indemnify and hold harmless FWCC from any and all causes of action, claims or demands arising out of or in any way relating to Parent’s and/or Child’s use of FWCC’s services, equipment or premises whether asserted by Parent or third parties who may be injured arising from or relating to Parent’s and/or Child’s use of FWCC’s services, equipment or premises.

 

4. Parent is fully aware of the risks and hazards connected with the activities of the Event, and Parent is aware that such activities include the risk of injury and even death, and Parent hereby voluntarily elects to allow Child participate in said activities, knowing that the activities may be hazardous to Child’s property and Child. Parent understands that FWCC do not require Child to participate in the Event or any activities involved therewith. Parent voluntarily assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by Child, or any loss or damage to property owned by Child, as a result of being engaged in activities of the Event, WHETHER CAUSED BY THE NEGLIGENCE OF FWCC or otherwise, to the fullest extent allowed by law.

 

5. Parent further hereby AGREES TO INDEMNIFY AND HOLD HARMLESS the FWCC from any loss, liability, damage, or costs, including court costs and attorneys’ fees that FWCC may incur due to Child’s participation in the Event, WHETHER CAUSED BY NEGLIGENCE OF FWCC or otherwise, to the fullest extent allowed by law.

 

6. It is Parent’s express intent that this Waiver of Liability and Hold Harmless Agreement shall bind Parent, Parent’s heirs, representatives or assigns and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above named FWCC. Parent hereby further agrees that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Louisiana and that any mediation, suit, or other proceeding must be filed or entered into only in Louisiana and the federal or state courts of Louisiana. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.
